- interfere with the website's operation, security, availability, or privacy controls;
- introduce malware, harmful code, abusive traffic, or deceptive content;
- impersonate another person or misrepresent your authority or affiliation;

- use automated systems in a way that creates an unreasonable load, bypasses controls, or extracts protected content; or

3. Website information is not professional advice
Website content is provided for general business information. It describes operating problems, consulting concepts, service stages, and examples at a general level.
The website does not provide legal, tax, accounting, investment, clinical, cybersecurity, or other regulated professional advice. It also does not provide a diagnosis of your business merely because you read the content, submit a booking request, or participate in a discovery conversation.
You remain responsible for evaluating information in the context of your business and for obtaining appropriate professional advice where needed.
4. Discovery conversations and consulting engagements
Submitting a request or booking a discovery conversation does not require either party to enter a consulting engagement.
The discovery conversation is not the 72-hour Diagnostic. It does not include a Profit Leak Map, formal assessment, or consulting deliverable. A 72-hour Diagnostic, 14-day Guardrails Install, or Monthly Retainer begins only after the parties accept a separate written agreement covering the applicable scope.
Information on the website about services, timing, fit, or possible next steps is descriptive. It is not an offer that can be accepted solely by using the website or booking a conversation.
OpsHub may decline an inquiry or proposed engagement when the need falls outside its scope, appropriate participation or access is unavailable, a conflict exists, or the engagement is otherwise not a suitable fit.
5. Client agreements control consulting work
If you enter a consulting engagement with OpsHub, the signed client agreement controls that relationship.
The client agreement may address:
- the operating question and scope boundary;
- participants, access, and client responsibilities;
- deliverables and permitted use;
- timing and change control;
- fees, invoicing, taxes, and payment terms;
- confidentiality, information security, and approved data-sharing channels;
- intellectual-property ownership and licenses;
- suspension, cancellation, and termination;
- warranties, disclaimers, indemnities, and liability; and
- dispute resolution and other legal terms.
If a signed client agreement conflicts with these website Terms regarding an engagement, the client agreement controls for that engagement to the extent of the conflict.
No website statement changes a signed client agreement unless the change is made through the process required by that agreement.
6. Your information and responsibilities
You are responsible for the accuracy of information you submit and for having the right to provide it.
Do not submit customer or patient records, payment-card information, account credentials, sensitive personal information, regulated data, or detailed confidential operating records through a booking note or general inquiry channel.
If more detailed business information becomes relevant, OpsHub and the prospective or current client must first agree what is necessary, who may provide it, and which channel may be used.
Our handling of personal information associated with the website, booking, inquiries, and applicable engagements is described in the Privacy Policy.
7. Intellectual property
The website and its original content, organization, design elements, text, graphics, methods, frameworks, names, logos, and other materials are owned by or licensed to TransformCraft LLC and are protected by applicable intellectual-property laws.
Operations Transformation HUB, OpsHub, the names of its service stages, and associated brand elements may not be used in a way that implies sponsorship, endorsement, partnership, or authorization without written permission.
These Terms give you a limited, revocable, non-exclusive, non-transferable right to access and use the website for its intended informational purpose. They do not transfer ownership of any website content or OpsHub intellectual property.
You may link to a public website page in a lawful and accurate way that does not imply endorsement. We may request removal of a link that is deceptive, unlawful, harmful, or presented in a misleading context.
8. Materials used in consulting engagements
Ownership and permitted use of consulting deliverables, client-provided materials, OpsHub tools, templates, methods, pre-existing intellectual property, and engagement-specific work are governed by the signed client agreement.
Unless that agreement says otherwise, providing business information to OpsHub does not transfer ownership of the client's underlying materials, and providing an output to a client does not transfer ownership of OpsHub's pre-existing methods, frameworks, tools, or general know-how.
Nothing on the website grants a license to use a Profit Leak Map, template, assessment structure, or other consulting material that has not been provided under an applicable agreement.
9. Public evidence, testimonials, and case material
OpsHub does not obtain permission to publish client-identifying information merely because a person submits an inquiry or enters an engagement.
Any public testimonial, case example, result, or client-identifying reference requires the applicable source, permission, confidentiality, anonymization, wording, and legal checks.
Aggregated or de-identified information may be used only when permitted by the applicable agreement and law. It must not be presented as an identified client result without the required approval.
10. Third-party services and links
The website may link to or integrate with services operated by other organizations, including scheduling, consent, analytics, communications, or external websites.
Third-party services are governed by their own terms and privacy notices. OpsHub does not control and is not responsible for a third party's content, availability, security, or practices merely because the website links to or integrates with it.
Your use of a third-party service may create a separate relationship between you and that provider.
11. Website availability and changes
We may update, correct, restrict, suspend, or discontinue any part of the website when reasonably necessary. We do not promise that every feature or piece of content will always remain available, error-free, or unchanged.
We may correct typographical errors, technical problems, stale information, or inaccurate descriptions. A website correction does not alter a signed client agreement unless the agreement is changed through its required process.
12. No guarantee of business results
Operating outcomes depend on factors including the accuracy and completeness of available information, owner and team participation, implementation decisions, market conditions, third-party systems, and events outside OpsHub's control.
Examples, operating scenarios, service descriptions, or prior outcomes do not guarantee that another business will achieve the same or any particular result.
No website content, discovery conversation, assessment, recommendation, deliverable, or engagement removes the owner's responsibility for business decisions and implementation choices.
13. Disclaimer of warranties
To the fullest extent permitted by law, the website and its content are provided on an "as is" and "as available" basis.
OpsHub disclaims warranties regarding the website's uninterrupted availability, freedom from errors or harmful components, accuracy for a particular business decision, merchantability, fitness for a particular purpose, and non-infringement to the extent those warranties may lawfully be disclaimed.
Some jurisdictions do not permit certain warranty exclusions. In that case, the exclusions apply only to the extent permitted by applicable law.
Warranties, if any, relating to a paid consulting engagement are governed by the applicable signed client agreement.
14. Limitation of liability
To the fullest extent permitted by law, TransformCraft LLC, OpsHub, and their owners, personnel, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or connected with use of, or inability to use, the website.
This includes loss of profits, revenue, data, business opportunity, goodwill, or anticipated savings, even if the possibility of the loss was known.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Liability arising from a consulting engagement, including any applicable aggregate cap, is governed by the signed client agreement. These website Terms do not replace or enlarge that agreement's liability provisions.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless TransformCraft LLC, OpsHub, and their owners, personnel, and contractors from third-party claims, liabilities, damages, judgments, and reasonable costs arising from:
- your unlawful or unauthorized use of the website;
- information or material you submit without the necessary rights or authority;
- your infringement of another person's rights; or
- your material violation of these Terms.
This section does not apply to the extent a claim results from conduct for which OpsHub is legally responsible. Any engagement-specific indemnity is governed by the signed client agreement.
16. Suspension and termination of website access
You may stop using the website at any time.
We may suspend or terminate access to the website when reasonably necessary to protect the website, enforce these Terms, comply with law, respond to security or misuse concerns, or discontinue the website.
Provisions that by their nature should continue after access ends will survive, including provisions concerning intellectual property, disclaimers, liability, indemnification, governing law, and disputes.
Ending website access does not automatically terminate a consulting engagement. An engagement may be ended only under its signed client agreement.
17. Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Before filing a claim concerning these Terms or the website, you and OpsHub agree to send written notice describing the dispute and attempt in good faith to resolve it for 30 days. This requirement does not prevent either party from seeking urgent injunctive or equitable relief where appropriate.
Unless applicable law requires otherwise, claims that are not resolved through that process will be brought exclusively in the state or federal courts located in Dallas County, Texas. You and OpsHub consent to the jurisdiction and venue of those courts.
Any dispute arising from a consulting engagement is governed by the dispute terms in the applicable signed client agreement.
18. Changes to these Terms
We may update these Terms when the website, services, providers, law, or business practices change.
The effective date will be updated when revised Terms are published. The revised Terms apply to website use after that date. They do not retroactively amend a signed client agreement.
Your continued use of the website after revised Terms take effect constitutes acceptance of those revised Terms to the extent permitted by law.
19. General provisions
If a provision of these Terms is held unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver of the right to enforce it later.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, financing, sale, or transfer of the website or business, subject to applicable law.
These Terms and the Privacy Policy are the entire agreement concerning use of the website. They do not replace a signed client agreement or a third-party provider's terms.
